    Swandev withdraws spoliation order

    MARONDERA– The Municipality of Marondera says Swandev (Pvt) Ltd, a local land developer which has been haggling with the local authority for the control of land at Elmswood officially withdrew the spoliation order which it had lodged with the High Court of Zimbabwe.

    Kudakwashe Tapfumaneyi who is the council’s public relations officer said the spoliation order application was withdrawn with costs and this will allow the municipality to proceed with the allocation and servicing of the Elmswood residential stands without any legal challenge.

    He said: “The Municipality of Marondera wishes to inform residents and stakeholders about the outcome of the spoliation order (mandament van spolie) launched by Swandev with the High Court of Zimbabwe. The Elmswood stands have already been surveyed to title and council possesses all the relevant documentation. Currently, council is servicing the Elmswood residential stands by opening roads.

    “We would like to clarify that the Elmswood land is wholly owned by council and no part of the Elmswood land is owned by any other private developer or entity. Therefore, there is no joint ownership of the Elmswood land.”

    Tapfumaneyi further urged beneficiaries of the Elmswood Housing Project to remain patient as council implements the phased allocation of the residential stands.

    “Stands are being allocated to beneficiaries who have received offer letters and have met the thirty percent payment threshold. The deadline for meeting this payment threshold is November 30, 2024. Council will allocate stands to all beneficiaries who fulfil their payment obligations, ensuring that no one is prejudiced,” he said.

    He added that only the Municipality of Marondera has the legal authority to oversee the development, allocation, distribution and purchase of the Elmswood residential stands.

    The council’s public relations officer said: “No other entity has the legal right to receive payments or allocate and distribute Elmswood residential stands. Council will not be held liable for any losses that may accrue as a consequence of dealing with other parties or entities concerning the stands. Stakeholders are cautioned to be guided accordingly and we encourage those in need of land to follow the proper procedures.”

    In September, former Marondera Mayor Farai Nyandoro and his other co-accused – Tafira Makochekanwa, Tinodaishe Muraicho, Special Magirazi and Tichaona Murundo were dragged to court on fraud charges after reportedly impressing upon some home seekers that they would allocate them residential stands at Elmswood farm.
