Mubaiwa spared jail, fined $60 000 for marital fraud


Harare (New Ziana)-Harare magistrate Lazini Ncube on Thursday sentenced Marry Mubaiwa, Vice President Constantino Chiwenga’s estranged wife to one year in jail after she was convicted of fraudulently attempting to upgrade her customary marriage.

Mubaiwa was found guilty of violating the Marriages Act after fraudulently trying to solemnise her marriage to VP Chiwenga while he was in India for treatment in July 2019.

She however escaped a custodial sentence after the magistrate ruled she was not in good health to go to jail.

The magistrate said Mubaiwa was also not in good health to perform community service and deserves a second chance since she is a first time offender.

She was given an option to pay ZW$60 000 or go to jail for six months.

“The accused is not in good healthy as she is always seen with an aid. The accused is a first offender. The accused will not cause harm to society. She deserves a second chance,” Magistrate Ncube said.

After a full trial, the court said convincing evidence had been led in court proving Mubaiwa had violated the Marriages Act in her futile attempt to legally wed the VP.

The case, one of several she faces, contributed to the breakdown of Mubaiwa’s marriage to VP Chiwenga two years ago.

Since the breakdown of her marriage, Mubaiwa has fallen on hard times, with her health failing gravely and dramatically.
