Commissioner of Oaths up for fraud


A 52-year-old Bindura man, who is a Commissioner of Oaths recently appeared before
Bindura Magistrates’ courts after creating a false agreement of sale of an industrial stand.
Christopher Mutoriro of 2287 Chipadze Street, Bindura, pleaded not guilty when he appeared
before Magistrate Samantha Dhlamini, who remanded him to 16 December.
Sheila Maribha for the State, told the court that on an unknown date but during the period
extending from June 22 to November 11 at Bindura Municipality Town Housing Department,
Mutoriro, in the company of his accomplices, who are at large, created a false Agreement of
Sale in respect of stand number 2119 Light Industrial Area, Bindura, between Rosemary
Mafuta and Kelvin Ngodo, as the sellers, and Simon Konono as the buyer.
Armed with the fake agreement of sale, Mutoriro, in connivance with his accomplices,
presented it to Bindura Municipality, which acting on the misrepresentation, initiated the
process of change of ownership between the sellers and purchaser, thereby defrauding the
estate of Konono, the lawful and legal owner of the stand 2119 Light Industrial area.
Value of the stand is USD$90 000.
