Harare (New Ziana)-The Constitutional Court on Monday dismissed an application by MDC-T leader Douglas Mwonzora seeking to nullify a delimitation report produced by the Zimbabwe Electoral Commission (ZEC) on grounds it had no jurisdiction to hear the matter.
Mwonzora ’s party wanted the court to nullify the delimitation report, and postpone general elections due around August, by at least six months.
In passing the ruling, the court said it had no jurisdiction to hear the case.
“No course of action has been advanced by the application. Accordingly the application is dismissed with no order as to costs,” said the court.
Speaking to journalists after the ruling, Mwonzora dismissed the court judgement saying it was ‘political’.
“The Constitutional Court has dismissed our application and their argument is that they do not have jurisdiction. In other words, they do not have the power to hear the case.
“In our respectful view, the court has made a political judgement. It is unfair judgement and we do not accept that judgement,” he said.
Mwonzora said he would seek legal advice on how to further challenge the judgement.
“We want free and fair elections in Zimbabwe and there can never be free and fair elections when the delimitation report is so fundamentally flawed,” he said.
Senator Mwonzora was seeking to have the ConCourt set aside the delimitation report gazetted on February 20 February 2023; and order ZEC to redo the delimitation exercise and submit a new report. Mwonzora was also seeking relief to have the court postpone the general elections by interdicting President Mnangagwa from making the election proclamation, pending ZEC’s submission of a new and acceptable delimitation report.
