Ephias Mambume, the independent candidate for the upcoming Victoria Falls council by-election scheduled for November 30, has been disqualified from contesting due to unpaid council rates.
A recent court ruling confirmed that Mambume was ineligible to run after a petition was filed by his rival from the ruling Zanu PF party, who alleged that Mambume had defaulted on council rates for over 120 days.
The court’s decision was grounded in Section 119(2)(h) of the Electoral Act, which clearly states that any candidate who owes rates, taxes, or levies to the council and has been in default for more than 120 days prior to the nomination or election day is disqualified from being nominated or elected as a councillor.
In its ruling, the court emphasised the unambiguous nature of the law, noting that the provisions leave no room for interpretation.
Mambume had initially filed his nomination papers earlier this month, positioning himself as a formidable contender for the council seat. His campaign had reportedly gained significant traction, attracting support from various quarters.
However, shortly after the nomination court convened on November 15, 2024, his candidacy was challenged in court. As the Victoria Falls by-election approaches, the electoral process will continue on November 30, despite Mambume’s disqualification. The situation remains dynamic, with both political parties gearing up for a competitive election period.
